Ubix End User Service Agreement
PLEASE REVIEW THIS END USER SERVICES AGREEMENT CAREFULLY, AS IT CONSTITUTES A LEGAL AGREEMENT BETWEEN YOU AND UBIX INCORPORATED.
1. Ubix provides on demand software and services for the creation and distribution of electronic content. We provide training and customer support as needed. Our intent is to work closely with our customers to maximize the use of their leads and prospects by automating much of the communication. All private information gathered during this process is the sole property of you, our client.
2. Use of Services.
Customer acknowledges and agrees that it will use the Services only to access, employ, utilize, or display the Software solely for Customer's "internal business purposes" by Customer's employees or by independent contractors hired by Customer.
For the avoidance of doubt, the term "internal business purposes," as used herein, does not include, among other things, the right to:
(i) send spam or otherwise duplicative or unsolicited messages in violation of applicable laws;
(ii) send or store infringing, obscene, threatening, libelous, or otherwise unlawful or tortuous material, including material harmful to children or violative of third party privacy rights;
(iii) send messages to any non opt-in purchased (email) lists, distribution lists, newsgroups, or spam email addresses; or (iv) send or store material containing malicious code, including, without limitation, software viruses, worms, Trojan horses or other harmful computer code, files, scripts, agents or programs.
Customer agrees to report immediately to Ubix, and to use best efforts to stop immediately, any violation of the terms and conditions set forth in this Section 2 or any of the Policies.
3. FTC Compliance.
A brief overview of the Federal Trade Commission's CAN-SPAM Act can be found here. We require all users of Ubix services and software to strictly adhere to these guidelines. The Act in its entirety is available here.
4. ISP Compliance.
In addition to FTC guidelines, each ISP and email service has their own governing set of rules pertaining to the distribution of electronic content. Ubix uses its own IP address when sending your content. If our IP is blacklisted we will lose the ability to send for any company.
